User’s Acknowledgment and Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Sculptd Minnesota, LLC d/b/a EVOLVD (“EVOLVD,” “we,” “our,” or “us”) located at 6906 153rd St W, Apple Valley, MN 55124.

By accessing or using any EVOLVD websites, digital forms, communications, or wellness and aesthetic services (collectively, the “Services”), you agree to be bound by these Terms.

Clinical services offered to EVOLVD clients, including medical evaluation, diagnosis, and prescribing, are provided solely by licensed medical professionals through an independent affiliated medical group (the “Medical Group”). EVOLVD provides administrative, wellness, aesthetic, and non-clinical support services, as well as certain delegated tasks under clinician oversight.

1. No Medical Emergencies

EVOLVD does not provide emergency medical care.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency facility.

2. Nature of Services

EVOLVD provides two categories of services:

2.1 Non-Medical Aesthetic & Wellness Services

These include facials, Peels, and other cosmetic or wellness treatments.
These services are not medical treatment and are not intended to diagnose, treat, or cure medical conditions.
Results vary and are not guaranteed.

2.2 Medically Guided Services

Medical weight loss, hormone optimization, peptide therapy, TRT, body contouring, dermaplaning, red light therapy, microneedling and related programs are provided exclusively by licensed clinicians through the independent Medical Group.
These providers:

Conduct telehealth visits

Determine medical eligibility

Order labs

Prescribe medications

Modify or discontinue treatment as clinically appropriate

EVOLVD does not control or influence clinical decisions.

3. Eligibility

You must:

Be at least 18 years old

Reside in and be physically located in Minnesota at the time of telehealth encounters

Provide accurate and truthful information

Agree to all required consent forms

The Medical Group may deny care at its discretion.

4. Telehealth & Medical Oversight

Telehealth consultations are conducted by independent licensed providers.
By using telehealth services, you acknowledge and agree that:

Providers exercise independent clinical judgment

No provider–patient relationship is established until approved by the Medical Group

EVOLVD has no control over medical determinations

Failure to complete required documentation or lab work may delay or prevent treatment.

5. Laboratory Services

We coordinate laboratory services through third-party partners.
You are responsible for:

Scheduling lab work

Completing labs within required timeframes

Any costs associated with repeating labs due to delays, errors, or expiration

Lab results are reviewed by licensed providers only.

6. Prescription Medications

All prescriptions are:

Issued solely by licensed clinicians

Filled by third-party 503A/503B pharmacies

Non-returnable and non-refundable once processed

Medication shipments, delays, or issues are handled by the pharmacy, not EVOLVD.
We will assist with communication if needed.

7. Non-Invasive Body Contouring Services

You must complete all required consent and waiver forms before treatment.

Contraindications may include:

Pregnancy

Pacemakers

Metal implants

Active infections

Certain medical conditions

We may decline treatment at our discretion.

All sales are final except in rare, exceptional cases in which no sessions have been used.

Before-and-after photography is optional and used only with explicit written consent.

8. Payment Terms

All services are self-pay. EVOLVD does not accept insurance or process insurance claims.

You agree to:

Pay all fees at the time of purchase

Maintain accurate payment information

Accept that rendered services are non-refundable

The following are strictly non-refundable:

Lab tests

Virtual consultations

Provider reviews

Prescriptions once processed

Any service already performed

Partial refunds for unused body contouring sessions may be issued only in exceptional circumstances and at EVOLVD’s sole discretion.

9. Subscriptions and Recurring Billing

Some programs operate as memberships or monthly subscriptions.
By enrolling, you authorize automatic recurring billing.

Cancellation Requirements:

Must be submitted 5 days before the renewal date

Must be submitted via email or through your client portal

Charges already processed are not refundable

Once a prescription tied to a membership has been authorized and transmitted to the pharmacy, it is non-refundable, even if a cancellation request is submitted afterward.

Exceptions may be granted only when:

A prescription was sent in error AND not yet processed

Duplicate charges occurred

All requests must be emailed to [email protected].

10. Communication Consent (SMS/Email)

By using EVOLVD services, you consent to receive:

Appointment reminders

Account notifications

Program updates

Required administrative communications

You may opt out of marketing messages at any time.

Message/data rates may apply. Message frequency varies.

11. No Insurance Claims

You agree not to submit any EVOLVD or Medical Group invoices to insurance, Medicare, Medicaid, or any third-party payer.

12. Service Modifications

We may update, modify, or discontinue services, pricing, or provider availability at any time without notice.

13. No Medical Guarantees

All services are provided “as is.”
We do not guarantee specific results.
The Medical Group does not guarantee medication effectiveness, weight loss outcomes, or treatment success.

14. Limitation of Liability

To the fullest extent permitted by law:

EVOLVD is not liable for indirect, incidental, or consequential damages

Our total liability is limited to the amount paid in the 12 months preceding a claim

The Medical Group is solely responsible for clinical care

15. Arbitration Agreement

All disputes must be resolved through binding arbitration in Minnesota under the rules of the American Arbitration Association.

You waive:

Right to a jury trial

Right to participate in class actions

You may opt out within 30 days of accepting these Terms.

16. Force Majeure

We are not responsible for delays or service failures due to events outside our control.

17. Indemnification

You agree to indemnify and hold harmless EVOLVD, its owners, employees, affiliates, clinicians, and partners from any claims arising from your misuse of the Services or violation of these Terms.

18. Severability

If any part of these Terms is deemed unenforceable, the remainder remains valid.

19. Entire Agreement

These Terms constitute the entire agreement between you and EVOLVD and supersede all prior agreements.

20. Updates to Terms

We may update these Terms at any time.
Continued use of Services indicates acceptance.

21. SMS Program Terms

We send appointment information - confirmation & reminder messages to customers once they have booked an appointment and have opted-in to receive promotional and notification messages.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.
